What are the elements of a strangulation charge in Virginia?

    The prosecution must prove the following elements beyond a reasonable doubt in order to convict someone of strangulation in Virginia:

    • The defendant knowingly, intentionally, and unlawfully applied pressure to the victim's neck,
    • This pressure restricted the victim's breathing or blood flow, and
    • This caused the victim wounding or bodily injury.
